CHARLOTTE, N.C. (March 3, 2008) – Penalties NASCAR assessed Rusty Wallace Racing for a violation found during Speedweeks at Daytona International Speedway have been repealed by the National Stock Car Racing Commission, it was announced Monday.
NASCAR had said that in post-qualifying inspection on Feb. 15, officials discovered the oil reservoir tank cover was not fastened securely in five cars. The No. 64 car fielded by RWR with Ed Rensi as the owner and David Stremme the driver was one of the five. Each driver and owner was docked 25points. A $15,000 fine was assessed, and crew chief Steve Darne was suspended for six races, until April 9, and placed on probation until Dec. 31.
In deliberating the appeal, the panel also considered the section of the rule book dealing with the passage of air into or out of the car.
After reviewing the testimony and evidence presented during the hearing, National Stock Car Racing Commission Chairman George Silbermann, and commission members Russell Hackett and David Hall determined the cover appeared to be fastened and all bolts appeared to be fully engaged. The slight deflection at one corner of the cover, which gave rise to the penalty, was arguable, given the overall design of the oil tank reservoir encasement, the panel said in explaining its decision to rescind the penalties.
